Exploration for oil, gas and other hydrocarbons is regulated by the state of Michigan through the Michigan Department of Environmental Quality. Pursuant to section 205(2) of the Michigan Zoning Enabling Act, county and township ordinances such as zoning ordinances that would prohibit hydrocarbon exploration or mining of other natural resources are null and void without proof of actual damages to a community and its residents caused by these actions.
Because of an oil/gas exploration project that took place in Shelby Township near 25 Mile and Dequindre roads and the actual damages it caused the township, its residents and their property, the Shelby Township Board of Trustees has taken several initiatives to protect its residents from future crises and mitigate further damages.
Outlined below is a timeline of the actions taken, the events that transpired and resources shared with other communities as they face challenges posed by the prospects of oil/gas exploration that does not meet with pre-existing local zoning and construction ordinances.
